A Shoppers Value Foods customer filed a lawsuit in Arkansas County against the grocery store for injures suffered while shopping there.
The lawsuit, filed November 14, 2019, states on September 15, 2018, the plaintiff was a business invitee upon the premises, located on 102 E. 22nd Street in Stuttgart, AR.
While shopping for groceries, the plaintiff stepped in an accumulation of clear liquid that was on the floor near the freezers. The plaintiff slipped and fell.
According to the lawsuit, an employee advised the plaintiff that a pallet of frozen food with dry ice and wrapped with plastic had been placed on the floor earlier and water and condensation came off of the pallet causing the accumulation of liquid on the floor.
According to the lawsuit, there were no caution or wet floor signs in the area. The plaintiff claims her fall on the floor caused her injuries.
In the lawsuit, the customer alleges Shoppers Value Foods created a dangerous condition on its premises and failed to warn the customer about it.
The defendant states the injuries were caused by the omissions of negligence.
The plaintiff is requesting a trial by jury seeking a judgment amount against the defendant for her personal injuries, present and future pain and suffering, medical and related expenses and for all other costs and relief she may be entitled to.
